According to Alvarado, this contract supposedly had been signed illegally, since it is not determined whether it was under the concession or management modality.
Alvarado indicated that presumably this contract is not equitable. He said that of the value collected for the penalties against offenders, 51.5% corresponds to the Municipality of Ambato and 48.5% to the company, but after administrative deductions from the concessionaire. Therefore, he mentioned that the contract must be annulled.

The Ambato councilor, Robinson Loaiza, recalled that in 2018 they participated in the Inspection Commission of the National Assembly, but that there was no progress in those meetings. He said that the sanctions through the photo-radars would have been allegedly illegal.
Loaiza indicated that between 2015 and June 2021 through the fotorradares fines were collected that add up to approximately $ 53 million, of which $ 28 million were for the Municipality and $ 25 million for the company.
The mayor also said that for the ninth photosensor located on Bolivariana Avenue, which is within the state road network, some 32,000 sanctions have been issued, which would add approximately $ 60 million in fines.
After the meeting in the Commission of the National Assembly, the mayor of Ambato, Javier Altamirano, stated that strict compliance will be given to what is stated in the contract, that is, to verify the possible breaches of the company.
According to the mayor, the Ministry of Transportation and Public Works (MTOP) did not grant permission for the placement of the ninth photo-rail, so its location and use is illegitimate.
He said that the appropriate legal figure to use to terminate the contract will be analyzed. The official said that legal actions will be activated so that the “illegitimate” values that have been collected for the fines are returned to the public. (I)
