The event would have occurred on January 3, 2023. According to the version of the victim’s mother, the two men violently entered her home that day, as they made her believe that her brother had been stabbed, but it was an excuse for her to open the door.
Wilmer C.’s companion took a phone charger and choked her unconscious. The defendant heard the crying of the baby, went to the room, took the child and allegedly dropped him on his head.
The woman’s partner stated that at approximately 5:30 p.m. he arrived with his mother at his home and found the door half-open.
He pointed out that he thought it was a robbery, because he found everything in disorder, but he found his partner on the floor, handcuffed, with a cable around his neck and foaming at the mouth. He revived her by giving her mouth-to-mouth resuscitation.

After presenting the elements of conviction, preventive detention was requested for the crime of murder. The suspect was apprehended in the Pueblo Solo Pueblo neighborhood, in southern Quito.
“This is because of your brother’s debt,” would have been the words the newborn’s mother heard before seeing Wilmer C. take her son.
The crime of murder is sanctioned with a custodial sentence of 22 to 26 years when there are situations of defenselessness, inferiority or taking advantage of that situation. (YO)
