The Ministry of Defense of Kazakhstan has proposed introducing administrative and criminal liability for the dissemination of fakes or information that discredits the Kazakh Armed Forces during a special period. It is reported by Sputnik Kazakhstan.
According to the clarification of the military department, a special period is understood as a crisis period, which is introduced in accordance with the laws of Kazakhstan “On martial law”, “On a state of emergency” and “On countering terrorism”.
As noted, in peacetime, in accordance with Article 20 of the Constitution of Kazakhstan, censorship is prohibited. At the same time, in accordance with paragraph 3 of the same article of the Constitution, propaganda or agitation of a violent change in the state constitutional system, violation of the integrity of the Republic, undermining the security of the state, etc. is not allowed.
At the same time, liability for the dissemination of deliberately false, unreliable and destructive information or information that discredits the Armed Forces of the Republic of Kazakhstan, other troops and military formations is not provided for by law. The department believes that in a special period, the dissemination of such information can cause significant damage to the civilian population and the security of the state.
