How to count the days of natural or working holidays

In Spain, the paid vacation They’re a obligation contained in article 38 of the Workers’ Statute, where it is detailed that, at a minimum, each person hired must enjoy 30 calendar days paid vacation by the company for each year worked.

That is, from the moment you start working, the employee generates vacation days. This period, paid annual leave, are not substitutable for any financial compensation. Companies have to apply the collective agreement that corresponds to their sector.

But there is a key detail that often creates confusion: the difference between calendar days and business days. It is essential to know the differences between the two well because, depending on the sector and collective agreement, vacations can be stipulated under either of the two methods.

Differences between calendar and business days

1. Calendar days: if not specified, when speaking of “one month of vacation”, it refers to 30 calendar days. When we talk about calendar days, we refer to both weekdays and weekends and holidays. That is, vacation days will go counting from monday to sunday. The rule is: 30 calendar days of vacation / 12 months of the year = 2.5 days

2. Business or business days: Business days are Monday through Friday and business days include Saturday. In principle they are the days you work. In other words, only working days will be deducted from your vacation. The rule is: 22 working days of vacation/12 months of the year = 1.8 vacation days per month.

How calendar days and vacation business days are spent

The best way to understand the process for counting vacation days and knowing exactly how many we will spend and when it is convenient for us to start and end the vacation is with an example.

Example: Ana wants to go on vacation to make a trip from December 1 to 11. December 6 and 8 are national holidays.

If Ana’s vacations are computed as natural days, you will spend a total of 11 days of your vacation. Two holidays that you should not have gone to work have been deducted as vacation days.

If Ana’s vacations are computed as business daysfor the trip they deduct five days of vacation.

Although at first glance the difference is enormous, the Workers’ Statute establishes that they are 30 calendar days per year the minimum that can be enjoyed, and the conventions groups collect this right as 22 days counted as working days. In the end, it’s the same, but you should pay attention whether or not in your case Saturdays and Sundays are included as business days or as holidays.
