The documents for the divorce petition constitute the necessary support for the issues raised by the claimant in the petition itself. Unfortunately, the statistics are inexorable – the number is growing. More and more couples with different years of marriage are deciding to break up. The formal step towards dissolving a marriage is the submission of a divorce petition by one of the parties to the court. What documents are needed for a divorce petition? What should such a lawsuit look like?

A divorce petition is a letter initiating a divorce case. The applicant party explains in its content that prompted it to file for divorce. The statement of claim should take a specific form. If we do not know how to prepare it, then it can be outsourced to a lawyer. It should be remembered that a very important aspect indicated in the statement of claim is whether the claimant demands a divorce without being found guilty or with a ruling of such guilt – the first variant is most often chosen, because a ruling on guilt usually requires at least several court hearings, as well as drawing to the light of all, often very personal, marital matters.

What should I attach to my divorce petition?

According to the applicable rules, a statement of claim should be submitted in writing in duplicate to the court’s administration office. Which court is competent? Well, it should be the one in whose district the spouses recently lived together, provided that at least one of them resides permanently in this district. If neither of them is there, then the case is referred to the district court competent for the place of residence of the defendant. If it is also impossible, then a petition should be filed with the court having jurisdiction over the plaintiff’s place of residence.

Initiating divorce proceedings is connected with the necessity to pay a fixed fee for the lawsuit in the amount of PLN 600. What do I need to attach to my divorce petition in order for it to be accepted at the registry? In order for this letter to meet the formal conditions, it must be attached:

• a copy of the lawsuit,
• 2 copies (original + photocopy) of the marriage certificate
• 2 copies (original + photocopy) of copies of birth certificates of minor children, if the spouses have them
• 2 copies (original + photocopy) of the certificate of income from the last 3 months.

The document may help us to complete a lawyer, provided that we decide to use his services. In order for the statement of claim to be accepted, a list of the documents listed above must be attached to it – these are absolutely basic copies, without which the court will not accept our statement of claim.

If in a divorce case we are going to discuss the topic of child support or maintenance for ourselves, then it is worth considering also adding other, additional certificates regarding our situation. This is, for example, about documents thanks to which we can prove the amount of costs incurred in connection with the maintenance of children. Such bills can make a big difference in determining the amount of maintenance due. In a situation where we demand maintenance for ourselves, then the following should be presented:

• income certificate,
• tax returns
• a list of the cost of living with bills.
