Is it possible to go for a walk with the dog on L4? The expert explains

Currently, there are no specific provisions in Poland regarding going out with the dog for a walk during sick leave. That is why this issue raises considerable thinness. How to be guided in such situations and what do we especially remember? We ask the lawyer Marzen Pilarz-Herzyk.

Marzena Pilarz-Herzyk, who is in social media as, reminds that there is no list of activities that are allowed during the period of sick leave and which should be avoided. Codes 1 (patient is to lie) and 2 (may walk) are not good guidelines to determine the limits of permissible activity.

Lawyer: I warn against such generalization

The expert notes that the code 2 is incorrectly treated as the one that allows de facto to all activities that you want to take. – We skip an extremely important aspect that “it can walk” allows for outputs, which are related only to the most important and necessary life activities. What’s more, any such activity cannot be contrary to the purpose of dismissal, and thus restore the ability to work. In addition, it must be in line with medical recommendations – explains the lawyer.

So we will not find the answer to the question of whether taking the dog is exceeding the correct way of using the exemption or not. – If the patient can perform the necessary activities of everyday life, it seems that the dog should be taken to such activities, this should not cause problems – says Marzena Pilarz -Herzyk.

– But I warn against such generalizations and encourage you to always remember that each case should be assessed individually. We cannot assume that in any disease a walk with the dog will not be a contraindication. Dogs also have different sizes, temperaments, and a walk with them can be a good training. One more question arises. Who would lead the dog if the person on sick leave was healthy and was not at home? – notes the expert.

The expert emphasizes that it is far from demonizing every leaving the house during the dismissal. However, he points out that every patient must be aware that the purpose of this right is to recover and sometimes a really common sense is enough to assess the situation. – So if in the discussed example the patient is recommended by a doctor, for example, a moderate physical effort, exercises, walks, I see no problem with taking a walk with the dog – he says.

How to behave when we go out with the dog during the release, and at that time ZUS controllers will not find us at home? – The reason for absence should be explained in writing. It is in our hands that what arguments we will use and whether we will indicate that going out with the dog was nothing that would go beyond the correct use of the release. Practice of some patients “I will write anything, I will not write anything” I advise against. The clerk will only have a letter ahead of him and it assesses the situation on this basis – explains Marzena Pilarz -Herzyk.

Changes in the provisions in the scope of exemptions

It is worth mentioning that it is planned to change the regulations regarding sick leave. Its purpose is to more precisely determine the “permitted” activities. – If someone expected a closed catalog of activities allowed during sick leave, unfortunately I have to disappoint. We will not wait for such a list. The draft regulations are still based on a lot of generality. However, there is consent to incidental activities that will not worsen the patient’s health and will not be contrary to the recommendations – says our interlocutor.
