In the justification of the Court, however, we read: “Michał Adamczyk is not actively legitimate to appeal the resolutions adopted on December 19, 2023: The National Media Council is not rooted in the Act in accordance with the Constitution of the Republic of Poland, the rights to appoint members of supervisory boards and public television management boards. The resolution adopted on December 26, 2023, therefore, did not have an effect in the form of the plaintiff’s appointment as the President of the Board of Telewizja Polska SA“.
