The trial of TV showman Kuba W. and former MP Janusz P. has just started. They were accused of illegal alcohol advertising on the Internet. Although both did not appear in court, their attorneys submitted several motions, including one to discontinue the case. The former politician’s lawyer argued this, among other things: the fact that Instagram – in her opinion – is not a public medium.

In recent years, Janusz P. and Kuba W. decided to try their hand at various businesses. Together with his partner Tomasz Cz. they decided to open a company producing alcohol, which famous men promoted on their social media. Over the years, they have shared many photos and videos of themselves consuming their own brand of alcoholic beverages.

City activist Jan Śpiewak became interested in the issue of advertising and promoting alcohol. He repeatedly accused famous people of violating the provisions of the Anti-Alcohol Act and filed reports with the prosecutor’s office. It is also thanks to him that Janusz P. and Kuba W. can now be held accountable.

Janusz P. and Kuba W. will appear in court. Their lawyer tried to argue that Instagram is not a public medium

The first hearing took place on Monday, June 17, but none of the defendants appeared in court. However, their representatives appeared and started by requesting that the proceedings be discontinued, pointing out that there were no signs of a prohibited act and that they were unaware of the lawlessness.

As reported by “”, Janusz P.’s attorney allegedly explained that the posts published by the former MP on Instagram were each time consulted with lawyers who gave the green light for their publication. She also questioned whether Instagram is a public medium. According to the lawyer, it is not, because – as she argued in court – you have to log in to use it.

The prosecutor did not agree with her opinion, stating that “Instagram is not a medium for a narrow group of users, but a channel that can compete with television in popularity.” Moreover, he admitted that the legal opinions cited by Janusz P. were one-sided.

The judge rejected the celebrities’ attorneys’ request to discontinue the proceedings, as well as their other requests. Among other things, to exclude the social party, i.e. Jan Śpiewak’s “Safe Poland for All Foundation”, from participating in the proceedings, because it is “contrary to the interests of the justice system”. Attorney of Kuba W. and Tomasz Cz. he also argued this with the fact that the activist called his clients “alcopaths”.

The second request concerned the referral of the case to the Court of Appeal in Warsaw to decide whether it should be heard by the District Court for Warsaw-Śródmieście or the District Court in Warsaw. However, here too, nothing went as planned by the defendants’ lawyers and the case was not transferred to a higher court.

When the prosecutor read the indictment, the trial began. The next hearing date is set for August 28. Then, explanations are to be provided by the defendants who were summoned by the judge, and not who were merely notified about the case. The whole case is the result of last year’s penal order, which found all three defendants guilty and imposed fines on them. The parties filed an objection to the order judgment and the case became the subject of normal court proceedings.

According to , investigators showed that Janusz P. from October 2, 2020 to January 7, 2023, posted 264 materials on his social profile, including 181 videos and 83 photos in which he advertised alcoholic beverages. In turn, Kuba W.’s profile included 12 materials advertising alcohol from April 21, 2021 to January 7, 2023.
