Each employee has the right to leave, and its amount depends on the length of time and form of employment. In theory, the principles are well known, but practice varies. Can I take half a day off? Who is entitled to annual leave?

Everyone is probably looking forward to a vacation, and not only because they are away from work. Theoretically, employees know the rules for granting it and how many days of leave they have in a given year. In practice, not everything turns out to be as clear as you might suspect.

Who is entitled to annual leave? Check how many days of leave you can get

Every employee is entitled to annual leave, and its amount depends on the length of service.

  • Less than 10 years of experience: 20 days vacation in a calendar year.
  • Over 10 years of experience: 26 days of vacation in a calendar year.

In both cases, they are part of the holiday leave 4 days of leave on request. This limit is included in the allowance, which means that once it is used up, you cannot apply for it on demand. One day corresponds to 8 hours of work, which means that employees are entitled to 160 hours and 208 hours of leave, respectively.

Can you take half a day off? There is only one exception

Newly employed for the first time under an employment contract, as well as persons employed during the year, for part of a calendar year or for part-time, have holiday leave calculated proportionally. In their case, a partial day of leave is rounded up to a full day. This means that leave is granted, regardless of the situation, in each case only for a full working day. According to the Labor Code, it is not possible to grant leave, e.g. for a few hours or only for half a day.

However, there is one exception to this rule. Leave is granted in hours equal to the employee’s daily working time. One working day corresponds to 8 working hours. Therefore, if the remaining amount of leave to be used has fewer or more “hours” (working days) than the amount of work in the employee’s schedule, in practice the leave will be granted only for part of the day. For example, if an employee works 10 hours on a given day, he or she will have to report to work for 2 hours. If he works 6 hours on a given day according to the schedule, he will be able to pick up the remaining 2 hours on another day. If you feel like it, vote in our poll below.
