Each of us cares about privacy in our own area. We don’t want uninvited guests, so we separate ourselves from our neighbors with a net or fence. The best solution is to reach an agreement with your neighbor, share the costs and install one common net. Unfortunately this is not always possible. What to do if you don’t want to compromise and add more to the fence? Can you force him to pay?

In such a situation, the first thing you need to do is talk to your neighbor. You need his written consent if you want to build a fence on the border of two plots. Such a document should take the form of a contract containing all the details: dimensions and shape of the fence, construction and maintenance costs.

Pursuant to the Civil Code, a fence located on the border of plots is considered common and both parties are obliged to bear the costs of its maintenance, e.g. painting. The problem begins when one of the parties does not want to pay. Such cases often end up in court.

If you build a fence on your property and no elements are located on or beyond the property line, your neighbor is not obliged to reimburse you. What if the fence is built in the line separating neighboring plots? A neighbor may demand that the structure be demolished if he or she did not agree to it. If he reacts favorably and agrees to keep the net, then yes is not obliged to reimburse you part of the costs for its construction, since no joint arrangements preceded this investment.
