After how long can you lose the right to a grave? Probably not everyone is aware of the fact that burying the deceased in a specific grave means that his or her remains will rest there forever. How long they stay there is regulated by law. What is worth knowing?

In Poland, the vast majority of various issues and aspects are regulated by law. It is no different in the case of graves, or more precisely, the right to them. It turns out that in some cases it can only be assigned for a specific period of time. How to check?

What is the right to a grave? The law does not regulate this issue precisely

Issues related to burial are regulated by the provisions of the Act on Cemeteries and Burial of the Dead, and in addition they are supplemented by regulations of specific cemeteries. Importantly, it is worth mentioning at the very beginning that in Poland it is not possible to acquire ownership rights to a given grave, i.e. burial place. It can only be made available by the administrator for a fee and this right applies to both parish and municipal cemeteries. However, this is not the end of the curiosities, as neither the act nor the regulations explain the issue of the right to a grave. So what is it? Generally speaking, the right is a set of rights, including the right to a specific burial place, to hold ceremonies, as well as to the arrangement, decoration and care of the tombstone itself. Two issues are important here, namely the fee and who owns the right to the grave.

In the case of the right to a grave, the financial aspect is important, which is nothing other than the maintenance of the grave. Such a fee is called a deposit fee. By paying it at the time of purchasing the burial place and then creating the grave, we acquire the right to it for a specified period of time, most often 20 years. After this time, do it again otherwise, the grave may be used for the burial of another person. As for the amount itself, it depends, among others, on: from the location of the cemetery. In larger cities you pay much more, even over PLN 1,500 for a single grave.

According to the regulations, the right to the grave, including taking care of it and paying fees, belongs to the immediate remaining family. If there is more than one person, the administrator should be appointed with the consent of all authorized persons. In the event of disagreement in the family, it is determined by the court. According to most cemetery regulations, each grave should have an appointed administrator, i.e. guardian. He is the one who most often pays for the creation of the grave and signs the contract with the cemetery manager.
