After signing the contract, the tenant not only gains the right to use the premises. A common cause of conflict between the landlord and the person renting the apartment are unannounced visits. Can the owner enter the rented apartment?

Both the tenant, i.e. the person who rents, and the owner of the premises, i.e. the lessor, have a number of obligations and rights. One of them is the right to protection of inviolability and a sense of security. However, the landlord wants to make sure of the condition of his apartment or house. Can the owner of the apartment make an “inspection” and enter unannounced?

After signing the contract, each tenant, in addition to being granted use of the premises and the obligation to take care of its condition, also has the right to maintain “home privacy”. After renting an apartment, the owner loses the right to dispose of it, although he still remains its formal owner. It means that cannot enter the apartment unannounced, e.g. in the tenant’s absence, cannot search the tenant’s belongings and cannot make unannounced visits.

Does the landlord have the right to have the keys to the apartment? The owner may have his own set, but he cannot use it to check the condition of the premises in the tenant’s absence. Disturbing domestic peace is punishable by a fine, restriction of liberty and, in the worst cases, imprisonment for up to one year.

When can the owner enter the rented apartment? The law lists several situations

However, there are several situations in which the owner of the apartment may enter it even without prior notice of the visit and without prior arrangement with the tenant. These are also situations in which the tenant must provide the premises. When can the owner enter the rented apartment? When it comes to a failure that causes damage to the premises or threatens to cause it, for example:

  • gas leak,
  • smoke escaping,
  • failure resulting in flooding of the neighbor.

If the tenant is not present in the apartment or if he does not want to let the owner in even though there is a threat of damage, this can get inside with the assistance of the city guard, police or fire brigade. When it comes to necessary repairs and maintenance, including an inspection of the condition and equipment, the owner of the premises should arrange the date of the visit with the tenant in advance.
