It turns out that most cooperatives and communities have a provision prohibiting this type of practice in their house rules. The usual justification for such regulations is that the smoke emanating from the grill may disturb our neighbors. For breaking such regulations, we may receive a warning from the cooperative or housing community, and in extreme cases even a fine.

What do experts have to say about this? Legal advisor Ernest Burior spoke on the case on TOK FM. He recalled, among others, Fr Regulation of the Minister of Interior and Administration of June 7, 2010. – This is about fire safety regulations in real estate. Pursuant to this provision, it is prohibited to light a fire in places where flammable materials or adjacent objects could ignite, the expert said.

We may receive a fine for acting contrary to these regulations. In turn, Art. 144 of the Civil Code prohibits so-called indirect emissions, i.e. smoke and odors that could interfere with the use of neighboring properties. For this reason, a person who smells grilled food from a neighbor’s balcony may call the police or city guards. The culprit may receive a fine of up to PLN 500.
