It’s easy to unintentionally cause harm while shopping. It may be breaking a jar or bottle, tearing the handle off a cup, spilling flour or crushing it. This is a common sight in stores, and crowds of people and a large basket full of products do not help us be particularly careful. The employees take care of the cleaning, but what about the money? Do I have to pay for the damage?
Damage to goods in the store by a customer. Then you don’t have to pay for the damage
If you happen to break a jar at the store, don’t panic or run away. Also, do not hide damaged goods on the shelf. According to the Civil Code, “the seller is obliged to provide appropriate technical and organizational conditions at the point of sale to enable selection of the sold item and checking its quality, completeness and functioning of the main mechanisms and basic components.”
The conclusion is that not in every situation you are responsible for damaged goods. If you damaged a product because it was placed incorrectly on the shelf, you will not have to pay for it. The best example is when you take something off the shelf and other products start to fall as a result. This shouldn’t be the case and it’s the store’s fault, not yours.

The situation is different if you broke a jar because you missed the basket or dropped it from too high a height. Then the Civil Code applies, which states that “whoever, through his fault, has caused damage to another person, is obliged to compensate it.” If you’re not sure what happened, you can always ask to review the surveillance footage. There is one exception to this rule. Children under 13 years of age are not responsible for damaged goods. This is stated in the Civil Code, and it reads: “A minor who is under thirteen years of age is not liable for any damage caused.” However, the guardian must demonstrate that he or she took proper care of the minor at that time.
