Last week, the Ministry of Culture and National Heritage published a draft act on copyright and related rights prepared on the basis of a directive of the European Parliament and the EU Council. However, it does not provide for an obligation for streaming platforms to pay royalties. The proposal of the Ministry of Culture and National Heritage was commented on by representatives of the Association of Audiovisual Authors and Producers.
No royalties for streaming in the project of the Ministry of Culture and National Heritage
“New mechanisms in the form of statutory royalties were adopted during the implementation of the directive only in Belgium, Slovenia and Lithuania. However, the Ministry of Culture did not take into account the fact that countries such as France, Spain, Italy and Estonia have already had such regulations for a long time. have adopted in their legislation, and other countries, due to the lack of tradition of statutory royalties, have implemented Article 18 of the Directive in the form of other effective legal mechanisms, such as collective negotiations conducted by trade unions,” reads the content of the statement.
ZAPA representatives also emphasize that Netflix is currently the only service that provides for the payment of additional benefits to the creators of commercially successful works. EU regulations were supposed to be introduced in Poland almost 2.5 years ago. For now, the fine for failure to implement the directive is PLN 57 million, but it increases every day. The same mechanism covers royalties that should have already been paid to the authors, amounting to PLN 75 million.
