The apartment rental market is very popular. It’s becoming more and more difficult for Poles to get a loan, and the installment amounts are sometimes insurmountable, which is why many of us rent. Repair costs are often a controversial issue between the owner and the tenant. We explain who should pay for them and why it is not always the owner of the premises.

Who pays for a breakdown in a rented apartment? It’s best to clarify this issue in the lease agreement

A breakdown in the apartment is a normal thing and can happen to anyone. These can be minor defects, such as a clogged sink, but also more serious issues, such as a burst pipe, the repair of which involves high costs. Who bears them – the tenant or the owner of the premises? The answer is not as simple as it may seem. Many people think that the owner must pay for any defects, but this is not entirely true. The safest solution is to clarify this issue when signing the lease agreement. But what should we do if it is too late and we cannot change the contract?

What repairs are charged to the tenant? The owner does not have to pay for all failures

The law requires the owner to provide the premises fit for use and this obligation lasts throughout the entire lease period. This means that the owner is responsible for any defects inside the buildinge.g. if the water, gas or electricity installation has been damaged.

The tenant bears the costs of failures and defects “outside”. Therefore, it is responsible, for example, for the repair of furniture, devices, drains, and electrical installation protection. He talks about this:

The tenant is obliged to keep the premises and the rooms he is authorized to use in proper technical, hygienic and sanitary condition specified in separate regulations and to observe house order. The tenant is also obliged to take care of and protect against damage or devastation parts of the building intended for common use, such as passenger lifts, staircases, corridors, chute rooms, other utility rooms and the surroundings of the building.
