The court of first instance decided that Maciej Maleńczuk was to pay six thousand. PLN fine, PLN 1,000 as compensation for the anti-abortion activist, and also to cover the costs of legal representation of the opposing party. On December 14, 2021, this judgment was upheld.

The defense wanted an acquittal, and the private prosecutor would convict Maleńczuk for a month’s imprisonment suspended for two years. A private indictment on behalf of the anti-abortion activist Łukasz K. was prepared by the lawyers of Ordo Iuris. The prosecutor’s office joined the case.
It is about the events of December 17, 2016. At that time, a demonstration by the Pro-Law to Life Foundation was taking place in Krakow’s Main Market Square, demanding a law prohibiting abortion. There were also activists from the Committee for the Defense of Democracy, demonstrating their support for the opposition occupying the plenary chamber in the Sejm.
Łukasz K, a 27-year-old student, accused Maleńczuk of tearing the anti-abortion poster from him during the demonstration and slapping him in the face. Maleńczuk did not plead guilty, testifying during the appeal hearing that he “had to push him away because he pressed on him”. Maleńczuk emphasized:
I am innocent under the moral law.
Maleńczuk says that he spoke on behalf of all women in the Main Square and pointed out that the protesters showed the life-size naked, torn bodies of children in the place where the minors were.
The prosecution’s lawyers argued that Maleńczuk, after appearing in internet entries, “encouraged him with a language full of hatred for further acts of aggression.” The latter denied that the account belonged to him.
The trial in this case started in September 2018 (the case would be statute-barred in three days). – I will pay the entire fine, but if such a situation repeats itself in the public space, I will react similarly – after the verdict, Maciej Maleńczuk, quoted by “Gazeta Wyborcza”.
