Mateusz Matyszkowicz appointed a proxy who will not be able to be suspended by the new Minister of Culture, Bartłomiej Sienkiewicz. PO MPs assure that this will not protect TVP from changes.

On Wednesday, December 13, President Andrzej Duda appointed Donald Tusk as Prime Minister. We also learned about the composition of the Council of Ministers, which will consist of 26 members. Bartłomiej Sienkiewicz from the Civic Coalition became the Minister of Culture and National Heritage, who will influence, among other things, changes in public media.

The current president of TVP, Mateusz Matyszkowicz, has prepared for such an eventuality. According to Gazeta Wyborcza, in order to forestall Sienkiewicz’s decision to dismiss him from his position, Jacek Kurski’s successor appointed a proxy. The position was taken by Przemysław Herbut, who, according to the daily, has been associated with TVP for 9 years, and since 2022 he has been the Director of the Corporate Affairs Office.

The new Minister of Culture cannot suspend the proxy’s rights. Bartłomiej Sienkiewicz will only be able to suspend President Matyszkowicz, and then the company will be managed by a proxy indicated by him.

“The proxy would manage the company and appoint new managers, including those responsible for news and journalistic programs,” explains Herbut’s tasks, Agnieszka Kublik, the author of the article. They admitted that they did not know about the matter, but assured that changes in TVP were inevitable and the propaganda would soon disappear from the station.

“These are just legal details,” one of the PO MPs reassures in an interview with Gazeta Wyborcza. “They will be of no use, PiS is only proving to itself that it does not want to give TVP into independent hands,” he adds.

Lawyer, professor Katarzyna Bilewska explains on Twitter that “the commercial power of attorney granted to Mr. Herburt by the current management board of Telewizja Polska will expire by operation of law when the registry court appoints a curator for TVP.” This means “that the establishment of a commercial power of attorney will not block the appointment of a curator, also because the curator replaces the bodies, and the commercial proxy is only the company’s representative and cannot be considered a temporary body.”
