The announced staff changes at TVP after the current opposition takes power may be significantly more difficult. The latest amendment to the Code of Civil Procedure created by Prime Minister Mateusz Morawiecki and NSZZ Solidarno¶æ allows for the formation of groups of “non-dismissable” employees, employees who will have to remain at work under the current conditions until the end of any court dispute.

All because of the provision of Art. that enters into force on September 22, 2023. 755(5) of the Code of Civil Procedure, Art. added to this Act. 2 point 2 of the Act of July 28, 2023 and Article amended by this amendment. 477(2) par. 2 of the Code of Civil Procedure The amendment extends the institution of security to employee claims.

Until now, employees who decided to sue their employer for what they believed were unfair dismissal had to receive a judgment in order to be able to return to work. However, after the amendment, such persons will be able to apply to the court to secure a claim. If the court finds that such a request is well-founded, it will be obliged to order the employee to return to work until the judgment is issued.

Changes in TVP may be more difficult than it seems. PiS gave the green light to “concrete”

According to reports, the criteria that must be met to be “protected” raise considerable doubts. There are quite a few groups of this type specified in the Act, and joining many of them is very easy. This includes: for membership in trade unions or the Territorial Defense Forces. People who are members of trade unions or works councils, as well as those who have reached the age of pre-retirement protection, can also count on “protection”.

Dr. Marcin Wojewódka in an interview with the portal pointed out that thanks to the changes introduced, people who are “protected” may turn out to be completely irremovable. This is because the court ordering them to return to work may delay issuing a judgment for up to several years.

Under the current regulations, the new TVP authorities will not be able to effectively dismiss, among others, Krzysztof Nowina-Konopka, who works for “Wiadomości” TVP, who at the end of October this year. he boasted about joining WOT – informs the lawyer.

A much wider group of employees of government institutions may follow in the footsteps of the above-mentioned national media employee. If a large number of TVP employees suddenly join WOT or join unions, it may give them legal protection, thanks to which they will be able to enjoy jobs financed by taxpayers’ money for a long time.
