Breakdowns in apartments and houses happen, and the costs of repairing them can be really high. What if we notice that the radiator is leaking? Then it will be necessary to replace it. But who should pay for it? It turns out that in one case the housing cooperative will cover the repair costs.
Does the cooperative replace radiators when there is a breakdown? Yes, but only in one case
Replacing a broken radiator at the cooperative’s expense is possible only in one case and depends on the type of property ownership. In Poland, we most often deal with municipal premises, cooperative ownership right to the premises, tenants’ cooperative right to the premises and ownership. So who can count on the cooperative to pay for replacing the broken one? This applies only to people who have cooperative ownership rights to the premises. This is a type of ownership that does not give as many rights as in the case of a condominium, but in the event of a breakdown or the need for radiators, the housing cooperative will have to bear the related costs. This is discussed in the Act on Housing Cooperatives, and more precisely in Art. 1 section 3.
How to replace radiators? Sometimes you have to have permission to do this
Replacing radiators in a single-family house does not require notification or consent. However, the situation is different in , which are located in a block. They are connected by one system, which must meet several conditions for efficient operation. Therefore, if you want to make an exchange, you must report your intention to the cooperative, sending an appropriate letter and waiting for consent. This involves the need to turn off the heating during the replacement, which will also affect the comfort of neighbors during the peak heating season. It is also worth remembering that such activities should be carried out under the supervision of a designated conservator. Usually, if we do not comply with such rules, we can expect a financial penalty.
