Will Micha³ Wi¶niewski avoid prison? The lawyer tells you what the chances are

Just a few days ago, Micha³ Wi¶niewski was sentenced for a case from many years ago. He faces a year and a half in prison and a heavy fine. However, the musician can still avoid serving time in prison.

at the end of October he was convicted in a loan case from 17 years ago. He then assured the lender that he had the funds to repay the loan. This was not true and that is why the leader of Ich Troje has now received an invalid sentence of one and a half years in prison and a fine of PLN 80,000. Michał Wiśniewski is also to cover the costs of the trial.

However, a prison sentence does not automatically mean that the singer will go to prison. There’s also a chance it will never happen. In a conversation with Pudelek, lawyer Arkadiusz Szymański explains what may happen now.

Michał Wiśniewski sentenced. Will he go to prison?

Michał Wiśniewski can sleep peacefully for now. Until the verdict becomes final, the musician will not go to prison. Additionally, he has already announced that his lawyer will appeal against the verdict, which may mean a complete change in his situation.

An application for written justification of the oral reasons for the court’s decision will be submitted within seven days. A cursory analysis of the oral reasons presented by the court when delivering the judgment and the justification indicate already at this stage that appeals will be submitted in this respect, also regarding the assessment of the facts – said Michał Orlikowski, Wiśniewski’s lawyer, in an interview with Radio Szczecin.

Lawyer Arkadiusz Szymański says that the judgment of the appellate court may change the fate of Michał Wiśniewski. It may be completely different from the court of first instance, and it may also mitigate the first sentence. What speaks for Michał Wiśniewski is the fact that he does not plead guilty and has not been punished before.

Music will be imprisoned after the verdict becomes final. However, the court may also apply another type of execution of the sentence – not necessarily in prison:

It is theoretically possible to avoid imprisonment. The accused may apply for consent to serve this sentence under the electronic monitoring system. Such a punishment is served at home, under the remote control of the Prison Service, using the so-called bracelet – a device attached to the convict’s leg. The convict may stay outside his place of residence during certain hours, but during the hours indicated by the court he must be in the place where the monitoring device is located, Szymański explained.

What was Michał Wiśniewski convicted of?

In 2006, the musician took out a loan of almost PLN 3 million from SKOK Wołomin to build a house. In his declaration of assets, he certified that he would be able to repay such huge financing. What happened next is explained in different ways by Wiśniewski himself and the prosecutor’s office. According to Wiśniewski, when he took out the loan, he really had the means to repay it, but his financial situation suddenly deteriorated. According to the prosecutor’s office, the musician’s statement was untrue.
