The court dismissed TVN’s appeal. A film about Michalina Wisłocka for adults only

The Court of Appeal in Warsaw dismissed TVN’s appeal regarding the verdict regarding the broadcast of the film about Michalina Wisłocka. He therefore concluded that “The Art of Loving. The Story of Michalina Wisłocka” is a production intended for adult viewers.

The case was first brought to the District Court in Warsaw after the station broadcast at 8 p.m. and announced that it was intended for the 16+ age group. The National Broadcasting Council did not agree with the decision, the chairman of which stated that the sex scenes shown in the film were presented in a naturalistic way and were not suitable for minor viewers (Appendix No. 3, point I, point 3 of the Regulation of the National Broadcasting Council in connection with Article 18(5) of the Act ).

Therefore, it imposed a fine of PLN 20,000 on TVN. The District Court in Warsaw agreed with the decision of the National Broadcasting Council. TVN therefore appealed to the Appellate Court, but it was rejected. The film about Michalina Wisłocka was deemed inappropriate for viewers under 18 years of age. It was also found that although other broadcasters also sometimes violate this Act, it does not matter in this specific case.

Meanwhile, the creators of “The Art of Loving” emphasized from the beginning that the main topic of the film was not so much sex itself, but intimacy and the psychology of social behavior. “Nowadays, we may no longer need so much substantive knowledge, because sex and pornography are bombarding us from every side, but we have forgotten about the other side, the psychological one,” said the director, Maria Sadowska.
