KRRiT is chasing a non-existent band for a clip from 14 years ago. One of its members filed an appeal

The National Broadcasting Council is demanding payment of PLN 10,000 from the defunct band Fabuła for violating a number of sensitive content regulations in one of their clips from 14 years ago. One of the members of the former formation, £ukasz “Poszwixxx” Poszwa, decided to appeal against the decision of the chairman of the National Broadcasting Council.

The fact that officials from the National Broadcasting Council decided to x-ray the text of the song and music video from 14 years ago was announced at the end of June by the rapper Łukasz “Poszwixxx” Poszwa. He revealed that the chairman of the National Broadcasting Council, Maciej Świrski, imposed a fine of PLN 10,000 on him. All because of “promoting psychotropic and narcotic drugs” in the clip for the song “Życzeń death” from 2009, which was created as part of the hip-hop group Fanta, to which Poszwixxx belonged. The music video is currently unplayable in Poland.

In a post on Facebook, the music producer quoted some excerpts from the letter he received from the National Broadcasting Council. It shows that officials did not like part of the clip, which shows the torture chambers, where the performer takes an “ax swing towards the neck of the victim lying on the table”.

The National Council also has reservations about scenes where alcohol is consumed and those where various logos appear, including one belonging to the “dopalaczecom” website and the address. “Then we see the same person snorting white powder, which is supposed to represent taking amphetamines or cocaine. Also in the lyrics of the song there are references to taking drugs: ‘these drums are banging on the pot, kicking like a pill, (…) it’s pure natural coca’ ” – we read in the analysis.

They also did not like scenes suggesting “murdering a person” or another “consumption of alcohol”. “The broadcast also shows a scene of a man being buried alive, as well as a scene of sexually objectifying a teacher’s treatment of a student in a way that presents the possibility of sexual exploitation of minors as a sign of achieving a certain position or expression of self-confidence” – added. “During the entire recording, vulgar terms and threats are made against unspecified people, and violence and aggression are treated as privileges,” sums up KRRiT.

The rapper does not want to owe KRRiT. He appealed the decision

Rapper and music producer Poszwixxx immediately announced that he would not want to pay the fine and would take the whole case to court. According to the portal, that’s exactly what happened. The editors of the website managed to talk to the artist’s lawyer, Tomasz Chudziński, who informed about the appeal against the decision of the National Broadcasting Council.

“Now we wait. An appeal in such a case is characterized by the fact that it is addressed to a common court, although it is an administrative decision that considers it in terms of its merits,” he said in an interview with the website. He also added that at the moment he is not convinced that the appeal has been forwarded to the court, because it was submitted through the chairman of the National Broadcasting Council, who may also first overrule his decision. However, so far the lawyer does not know any specific information.

Chudziński also mentioned what will happen if the appeal finally reaches the court. It turns out that the first stage in the case would be to consider Poszwa’s application for exemption from court costs, which they submitted as part of their appeal. The lawyer also added that the trial could drag on for years. “The review time by the Court of Consumer Protection and Competition is about two years, I assume” – he concluded.

Fabia is a Bialystok group of rappers that operated from 1999 to 2014. It was created by artists using the pseudonyms: Poszwixxx, Ede, Konradziwo, DJ Perc and Bezczel (the rapper died on September 21, 2021). The group recorded four albums, of which the first two “Żywioł” (2003) and “CDN” (2005) were the so-called “illegals”, and the next two – “Work of Art” (2009) and “Made in 2” (2011) were released by Step Records.
