What trees can be cut down without permission? You can pay dearly for arbitrariness

Are you going to cut trees from your private property? It is better to hold off and look at the new regulations, because in 2023 they have undergone some modifications. Depending on the species and size of the tree, a special government permit will be required. However, there are exceptions to this rule in some cases. So which trees can we cut down without prior approval? And thus protect yourself from the consequences in the form of a fine.

While some might reply that within a private garden we should be able to plant and dispose of whatever plants we want, from a legal perspective this is not the case. Uncontrolled felling of trees on your own can lead to serious damage to the functioning of the surrounding ecosystem, but also not only – it can also have fatal consequences for the entire spatial plan in a given area.

Therefore, before we eagerly start cutting trees from our own property, it is worth getting acquainted with the regulations in detail. Especially since there has been a change since 2023, the knowledge of which will save us time, stress and above all – money.

To cut down a tree on your plot, you must obtain a special permit. To do this, go to the nearby city or commune office. This application can be submitted in person at the office building or online, without leaving home. However, before we start filling in all the necessary fields in the document, we should arm ourselves with knowledge about the age of the trees we want to cut and the circumference of its trunk. This information will be crucial for the decision of the office. The waiting time for permission (or refusal) is from 7 to 14 days,

There are, however, a few exceptions to this rule. When do you not have to apply for a felling permit without exposing yourself to any unpleasant consequences? Well consent for felling is not needed if the perimeter of the trunk of a given tree at a height of 5 centimeters from the ground does not exceed 80 cm. These are: poplar, silver and ash maple and willow. The situation is analogous in the case of a tree whose trunk circumference at a height of 5 cm from the ground does not exceed 60 cm (plane tree, black locust and horse chestnut) and 50 cm – this is where all other species come into play.

However, if you are tempted to circumvent these regulations and cut down a tree on your own that exceeds the specified dimensions – prepare for a fine. The amount will be twice the cost that legal felling of the same tree would generate. It is also worth remembering that, according to the legislator, tree felling is possible only outside the breeding season of birds – that is from October 15 to February 2.
