As reported by the nowiny24.pl portal, as many as 715 people in the Podkarpackie Voivodeship in the first half of 2023 had their sick leave suspended and lost the right to sickness benefit due to the use of L4 contrary to the purpose. The employer saw the photos on social media and reported them to ZUS
During her stay at L4, a hairdresser from the Podkarpackie Voivodeship went on a foreign holiday outside Europe. According to the portal przemysl.naszemiasto.pl, the woman later published photos from the trip on social media. She didn’t think about her actions. When the employer noticed this, he immediately notified ZUS and even provided screenshots. “Each person on sick leave must take into account the possibility of an inspection by ZUS or the employer” – said Wojciech Dyląg, ZUS spokesman in the Podkarpackie Voivodship, in an interview with the local portal.
Consequences of holidays during L4
ZUS and the employer have the possibility to check whether the sick person stays at the address indicated on the leave during L4 and does not allow any actions that may worsen the patient’s health condition and, consequently, delay the return to work. “If, for example, an employee, during the sick leave, was employed under a contract of mandate and performed it, or went on holiday or built a house during the sickness benefit, he loses the right to the benefit for the entire dismissal form, i.e. for the entire period for which the sick leave was issued” – explained the spokesman of the ZUS. In addition, it can also result in job loss.
