Peace and quiet, summer houses and well-maintained lawns are an increasingly frequent dream of many apartment dwellers. It happens, however, that some people sublease an allotment garden for days or days. We advise whether it is legal.
There are more applicants for ROD than plots. Allotment gardens revived during the pandemic
According to the portal, there are over 4,600 allotment gardens in Poland, most of which, as much as 84%, are located in cities. The popularity of ROD increased during the pandemic, when we could relax and break out of the four walls on our own piece of land. However, not everyone knows that you cannot buy property, and you can only lease it. Unfortunately, ROD is less than willing to lease, so some people decide to earn extra income and rent a piece of garden to others. Is such action legal?

Is it possible to rent a plot on ROD? The law is clear
The goal of ROD is to support the family, i.e. spending time outdoors, as well as cultivating your own garden. The allotment gardens are not intended for economic activity or to make profits from them, so according to them, renting a plot is not legal, and the penalty may even be the loss of the lease contract. So it is better not to practice such behavior, because we are responsible not only for our own plot, but also for the plots of neighbors and common areas, and we will bear the consequences of any damage.
