In 1985, Steven Avery was charged with aggravated assault, battery and rape by Penny Beernsten. He has had minor run-ins with the law before. As a teenager, he went to prison for breaking into a bar, returned to prison rather quickly – after setting a cat on fire – later, because he threatened his cousin with a shotgun. Although Avery had an alibi that was corroborated by more than a dozen people, Beerntsen’s testimony prevailed, identifying Steven as the perpetrator of the assault.

Steven Avery was sentenced to 32 years for rape and attempted murder. Although he claimed not to have committed the charges against him, he pleaded guilty in order to leave before the end of his sentence. He was released after 18 years.

Soon, the police found the burnt and buried remains of the photographer under the man’s house. In November of the same year, Avery was charged with murder, kidnapping and sexual assault, and mutilation of Halbach’s corpse. Also sentenced was 16-year-old Brendan Dassey, who appeared in court for complicity.

The boy pleaded guilty to the charges against him. He said that he took part in the rape of Teresa, and that Steven was responsible for killing and burning her. Both were sentenced to life imprisonment, but Dassey had the option of seeking a reduced sentence in 2048. It is worth adding here that the 16-year-old was extremely susceptible to any suggestions, because he is a person with an intellectual disability. Despite the lack of physical evidence to confirm the teenager’s words, the verdict was passed.
Avery appealed the court’s decision for years. He last applied for exemption in August 2022. Currently, Steven is being held at Fox Lake Correctional Facility. He was transferred to prison in June after years spent in a maximum security facility.
