As every year in the month of July, companies have the obligation to deposit the bonus for National Holidays to their employees. In view of the fact that the date to receive this labor benefit is approaching, it is important to know what actions to take if the company in which you work fails to pay the bonus or does not pay it on time, since it is stipulated as an infraction in the Regulation of the General Labor Inspection Law. What happens if my gratuity is not paid on time?

Companies have until July 15 for timely payment of the 2023 mid-year bonus. If the worker does not receive this labor benefit, they can contact their employer to file a complaint. This action can be carried out by phone or in writing before the human resources area, administration, among others.

Also, another action that employees can carry out is to communicate the non-payment of the bonus to their union body, if the company has one.

Where can I report if they don’t pay me my gratuity?

According to the National Superintendence of Labor Inspection (Sunafil), failure to pay this labor benefit is classified as a serious infraction, therefore, if the employer has already filed a complaint with the company where he works and does not has received a response, you can file a virtual complaint with the entity.

Sunafil will be in charge of inspecting the case and will request compliance. Otherwise, the organization will be fined. In the case of small companies, the amount can be up to S/22,275, while in medium and large companies the penalty amounts to S/129,294.

How to report a company in Sunafil?

Complaints before Sunafil range from non-payment of labor benefits to various types of harassment. These can be submitted through Sunafil’s digital system, which bears the name of Virtual Complaint Application and which can be accessed from the official website of the institution.

One of the advantages of this system is that the complaints are anonymous, so Sunafil inspectors can go to the company without having to specify the name of the worker who made the complaint.

How do I know if I’m due to receive gratuity?

All those workers subject to the general labor regime receive gratuities for the National Holidays, regardless of their contractual modality, in accordance with the requirements and conditions established by law.

Likewise, it is important to know that, to receive this benefit, the employee must have worked for at least one month in the semester between January 1, 2023 and June 30, 2023. The bonus payment will be equivalent to 1 /6 of your salary per month.
