And that eternal stench. You want to let some fresh air into your home, and here you can’t. Some argue that the solution to the problem would be to completely ban smoking on the balcony. What’s the law for that?
Can you get a fine for smoking on the balcony?
The Act of 8 April 2010 amending the Act on protection of health against the consequences of using tobacco and tobacco products and the Act on the State Sanitary Inspection does not prohibit smoking on the balcony. According to its content, smoking is not allowed:
- ? in hospitals and medical clinics;
- ? in workplaces;
- ? in nurseries, kindergartens, schools and universities;
- ? in cultural and leisure facilities for public use;
- ? in gastronomic and entertainment establishments;
- ? on public transport;
- ? at public transport stops;
- ? in the premises of sports facilities;
- ? on children’s playgrounds;
- ? in other public spaces
Attorney Łukasz Skiba, however, explained in an interview with woman.gazeta.pl that there are situations in which balcony smokers are not unpunished.
Although smoking cigarettes on the balcony is not prohibited, it is worth knowing that you can get a ticket for throwing cigarettes or brushing off ashes. The basis would be Art. 75 § 1 of the Code of Petty Offenses, which says that a fine of up to PLN 500 is subject to, among others, a person who throws away impurities. In extreme cases, in which the smoker acts maliciously or as part of a game ignoring the unlawfulness of the action, the penalty may be higher (up to PLN 5,000) and even take the form of restriction of freedom
