Think out loud Ed Sheeran (2014) and Marvin Gaye’s Let’s Get It On (1973) they are fighting. The estate of Ed Townsend, a musician and producer who co-wrote Gaye’s soul classic, They claim the song was plagiarized by Sheeran.

On Monday, a jury selection was scheduled to determine whether the British pop star Ed Sheeran ripped off American soul music legend Marvin Gaye’s “Let’s Get It On” while composing his 2014 hit “Thinking Out Loud.”

The lawsuit filed in 2017 eventually reached a trial expected to last a week in the Manhattan federal court of 95-year-old Judge Louis L. Stanton.

Plaintiffs argue that there “surprising similarities and clear common elements” between the two pieces of music. The jury’s decision, according to Time magazine, should be based solely on the analysis of the melody, harmony and rhythm, disregarding the contents of the letters.

It is not the first time Sheeran has been taken to court. In April 2022, the 32-year-old singer-songwriter won a legal battle when a court ruled against two musicians who accused him of copying one of his works, for his mega hit ‘Shape of You’.

Sheeran’s team has disputed the allegations made by Townsend’s estate. Maintains that “there are dozens if not hundreds of songs before and after” Gaye’s song“using the same or similar chord progression”.
