Pursuant to the regulations in force, all TV and radio receivers should be registered so that Poczta Polska can charge a subscription fee for their use. Designated inspectors can check whether, for example, the radio we have in the car has been reported to the office. If it turns out that the receiver is unregistered, the controller may charge a fee of “thirty times the monthly subscription fee”.

The fee for RTV in 2023 is higher than in previous years. The price for using the radio increased from PLN 7.50 to PLN 8.70 per month, and for the TV set (as well as the total fee for the radio and TV set) is now PLN 27.30 instead of PLN 24.50. This means that for a year of listening to the radio we have to pay PLN 104.40 to the government coffers, and PLN 327.60 for watching TV. Theoretically, every device in our home or car should be registered at the post office, and if the controller comes to us and finds that we have not fulfilled the obligation, he has the right to impose a penalty. And this will also be significantly higher due to the increases.

Subscription checks. How much is the penalty?

Pursuant to the applicable regulations, the inspector is obliged to charge a fee if during the inspection he finds that our receivers have not been reported to the office. This is “thirty times the monthly subscription fee applicable on the date of finding the use of an unregistered receiver”. Thus, according to the new tariff, the fine for unregistered radio is PLN 261, and for a TV set it is PLN 819. This also means taking evidence, which ends with an administrative decision with a registration order and determining the amount of further fees.

Who can check the RTV subscription? appoints duly authorized employees from the Financial Service Center for this purpose. A person who comes to carry out an inspection at our place is required to show the authorization to carry it out and a business ID. The inspected person also has the right to request the inspector’s ID card. You have to pay for a “receiver adapted to receive the program immediately”. Therefore, you do not have to pay for TV sets without an antenna or set-top box, and as indicated by Wirtualne Media, the same is true for smartphones, laptops, tablets, as well as TV sets that are used only as part of the “smart TV” function, i.e. watching movies and series available via VOD applications such as Netflix or Player.pl.

The controller cannot tell that the equipment is “immediate reception” just because there is a satellite or terrestrial antenna on the balcony or roof, similarly to the radio panel in the car. He needs to check that the device is working – and that’s only possible if we let him in.

Do we have an obligation to let a controller into the house or car?

On the website of Poczta Polska, we read that the inspected person “should enable the inspection of the obligation to register rtv receivers or show proof of registration” of the relevant devices. In practice, however, we do not necessarily have to do this.

Even if the controller imposes a penalty on us, you can also appeal against this decision. For example, if the fee was incorrectly calculated or the inspection was carried out incorrectly or was performed by an unauthorized person. Appeals should be sent to the Ministry of Infrastructure.
