The TSJPV ratifies the prohibition of consuming sweets and soft drinks in cinemas

The Court ratifies, for the time being, its decision not to revoke “the prohibition of consumption of sweets, soft drinks and the like in facilities where cultural activities are carried out under a regular regular schedule.”

The Contentious-Administrative Chamber of the Superior Court of Justice of the Basque Country (TSJPV) has ratified, for the moment, the prohibition of consuming sweets and soft drinks in movie theaters, decreed by the Basque Government.

The TSJPV, in an order made public this Tuesday, has decided to deny the precautionary suspension of the validity of this restriction provided for in the order of October 6 of the Minister of Health, Gotzone Sagardui, requested by the association of movie theaters of Euskadi, EZAE, and the Federation of Cinemas of Spain, FECE.

EZAE and FECE filed an appeal on October 26 in which they requested the TSJPV to urgently suspend, without listening to the other party, the prohibition of consuming sweets and beverages established by order of the Basque Government, among other measures to prevent the spread of the coronavirus pandemic. In his view, it is an “arbitrary and disproportionate” restriction and involves daily losses of 278,432 euros.

The very precautionary measures were rejected on the same day by the Contentious-Administrative Chamber, which considered that the Basque Government should be given the opportunity to present its arguments. After analyzing them, the TSJPV has decided, in an order, to deny the request of the associations of movie theaters, although it does not go into the merits of the matter, since it will have to decide later on the lawsuit after studying the case in depth .

In its resolution this Tuesday, the Basque Court ratifies, for the moment, its decision not to revoke “the prohibition of consumption of sweets, soft drinks and the like in facilities where cultural activities are carried out under a regular ordinary schedule.”
