Conforming unions in which there is a Labor Code

After three years, the National Council for Labor and Employment Promotion (CNTPE) and five agreements were reached in order to recover dialogue and improve the quality of labor regulations (see infographic).

It is necessary to remember that The CNTPE is made up of representatives of the trade unions, business associations and is headed by the Ministry of Labor and Employment Promotion (MTPE).

The Labor Code is cooked

In said session, it was agreed to evaluate the implementation of the dialogue between workers and employers regarding the preliminary draft of the Labor Code -pre-published a few weeks ago by the head of the MTPE, Betssy Chávez-.

This will happen once May 23 has passed, the date on which the deadline to receive comments related to the labor code in question expires.

“It is the commitment of the Government to sit here again, so that the preliminary draft (of the Labor Code) does not go directly to the Executive and Congress without prior debate,” said Chávez, who noted that representatives of the International Labor Organization (ILO ) will attend the debate between the unions and employees.

Will of the business

The president of the National Society of Industries (SNI), Ricardo Márquez, recognizes that the parties involved have managed to understand each other despite the prolonged inactivity of the CNTPE exacerbated by the pandemic.

“There are still 258 articles that must be agreed upon. There are about 12 days left to present our position, but we will need more days to reconcile. The important thing here is that we are all talking about the same thing: building trust between the union sector and the employers because we haven’t talked officially for three years. We have managed to trust each other again, ”he said for La República.

Márquez multiplies the effort to dialogue in the midst of the eternal political turbulence that shakes the country.

For his part, Omar Caipo, president of Confiep, stressed that Peru needs a Labor Code. “The minister (Chavez) was right and she has pushed us all. We are going together from the CNTPE and I am sure that the Congress will approve it quickly”, he indicated.

set a precedent

For the general secretary of the CGTP, Gerónimo López, the will to fine-tune criteria in the elaboration of the labor code -as reflected by Caipo- marks a precedent and fuels confidence.

He also recalled that the criticism towards the business sector resided in its limited sample to reach consensus in favor of the workers, to the point that “if something was agreed upon, they ended up kicking the ball”.

Formula to adjust the RMV periodically

It was also agreed to reactivate the Special Commission for Productivity and Minimum Wages to give it predictability and institutionalize the periodic adjustment of the Minimum Vital Remuneration (RMV). According to Márquez, an agreed formula will be established to determine how often the minimum wage will be raised.
