Companies that discriminate against their clients can receive fines of more than S / 2 million

Indecopi recalled that any act of discrimination against consumers due to their race, sex, religion, opinion, economic condition, or for any other reason, can result in a fine of up to 450 UIT, equivalent to S / 2 million 70,000 for the service provider O well.

Within the framework of the International Day for the Elimination of Racial Discrimination, and the International Day of Down Syndrome, the regulatory body specified that the Consumer Protection and Defense Code prohibits the exclusion of people “without objective and reasonable reasons”. .

These reasons for which a person’s access can be restricted are related to affecting security or tranquility. For example, users cannot enter an establishment while intoxicated or carrying weapons.

“The right to equality is recognized in the Political Constitution of Peru, so discrimination constitutes unequal treatment that, based on prejudice, affects the dignity of people,” Indecopi stressed.

In 2021, through the Inspection Directorate, Indecopi initiated 1,249 supervisions at the national level linked to discriminatory practices, 303 in Lima and 946 in regions. Meanwhile, so far this year, the institution has initiated 142 inspections at the national level regarding discrimination in consumption.

One of the supervisions carried out in this matter was the one carried out on the company Tai Loy SA, in response to the facts reported through Twitter about an alleged act of discrimination that occurred in its Barranco premises against an Afro-Peruvian citizen and her youngest son, in 2021. As a result of the investigation, the Control Directorate recommended the start of an Administrative Sanctioning Procedure to the Consumer Protection Commission No. 3, which is in process.
