The partners of the intervened cooperative Credicoop Arequipa, are awaiting the ruling of the Constitutional Court of the Court of Arequipa, on an amparo lawsuit to annul resolution 3609-2021 of the Superintendence of Banking, Insurance and AFP (SBS) . The last Tuesday the 15th ended the hearing where the parties gave their arguments.
They are different protection claims that were accumulated in a single process. They point out that the intervention resolution of the SBS violated due process and their rights.
One of the arguments of the partners refers that the due process of notification to the parties was not followed, in addition there were no previous reports. They add that the official who carried out the intervention would have expired. On the other hand, the defense of the SBS maintained that the entity acted according to its powers. Judge Karina Apaza del Carpio indicated that she will rule by office.
It is worth remembering that the members want to avoid the liquidation of the cooperative, since they indicate that with this they will not recover all of their deposits.
