An Institutional Participation Law “will strengthen social dialogue” in the CAV

A working group, as agreed between the Basque Government, employers and the UGT and CC unions. OO., will prepare the joint bases for a law that will provide legal certainty to the social dialogue table.

The social dialogue table has approved the creation of a working group to prepare joint bases for the elaboration of a proposal for an Institutional Participation Law in Euskadi, with which it is intended to “strengthen” social dialogue in the Basque Country and provide it with legal certainty.

These are some of the contents of the Work Plan for 2022 which, with 30 lines of action, was approved at the Euskadi Social Dialogue Table meeting held in Vitoria-Gasteiz, with the presence of Basque Government, CC. OO., UGT and Confebask.

The members of the table have stressed that social dialogue is “already an established reality” in the autonomous community, despite the fact that ELA and LAB, two of the main power plants, have not participated to date.

The members of the Social Dialogue Table have recalled that they had already reflected at the time on the advisability of creating a norm with the force of law that would regulate the institutional participation of trade union and business organizations and the Basque Government in the design processes of the public policies on labor relations and collective bargaining.

In this sense, its members consider that the course and importance of the agreements signed within the framework of social dialogue enable the commitment to “deeper reflection” in order to have a Law on institutional participation in the Basque Country, “which places Social Dialogue at the same regulatory level as that of other autonomous communities that already have said standard”.

In his opinion, institutional participation, regulated by law, must enable the “necessary” political, public and transparent debate on “the role played by social agents in a democratic society.”

They also believe that the institutional participation law should serve to strengthen social dialogue by providing it with “greater legal certainty.”

Among the measures agreed upon is the creation of various sectoral subgroups, including one to follow up on the first Labor Inspection Management Plan in the Basque Country, soon to be approved.
