They fine for the first time companies that obstruct negotiable invoices to mypes

The Peruvian Factoring Association (APEFAC) He reported that three companies were sanctioned with S/184 thousand (40 UIT) in total, for intentionally obstructing and challenging the flow of negotiable invoices to micro and small companies seeking liquidity.

This fact occurs for the first time since it was published in 2017 the supreme decree that regulated the sanctioning power of the Ministry of Production (Produce) for restricting said operations.

The companies fined are Mota-Engil Perú SA dedicated to engineering and construction with 10 UIT, Estilos SRL of the retail sector with 10 UIT and Vita Pharma SAC pharmaceutical laboratory with 20 UIT for infractions classified as Very Serious in the table of sanctions for not complying with the articles 3 and 9.

“We salute the control actions that the General Directorate of Supervision, Control and Sanctions of the Vice Ministry of MYPE and Industry of the Ministry of Production has been carrying out. It marks a before and after for the factoring industry. Now the big companies will think twice before wanting to disregard the regulation of negotiable invoices,” said Alejandro Niquen, president of APEFAC.

According to APEFAC estimates, 50% of micro and small companies will seek to advance the payment of their invoices via factoring this year. They foresee that sectors such as education, health, agricultural exports, construction and mining will enter this type of immediate financing. Likewise, Produce indicated that S/ 25,000 million will be exceeded in negotiable invoice operations in 2022.
