Indecopi: which companies received the highest fines for making calls without consent?

did you ever receive calls or text messages with promotions that you did not authorize? This is a fault that has been incurred by several Business in Peru. The National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) has imposed fines of more than 1,000 UTI (close to S/ 4,600,000) to offending companies.

Find out below the ranking of the companies that received the most severe sanctions. Since 2018, the companies and telemarketersalso known as ‘call centers’, have the obligation to ask for the consent of the clients to make calls, send text messages or emails.

Indecopi reminded the population to carefully read the terms and conditions of the services they contract to avoid authorizing the use of their data.

The companies that received the highest penalties

Between 2020 and so far in 2022, Indecopi’s Consumer Protection Commission No. 3 determined sanctions against 42 companies who made calls without consent. The maximum fine that can be imposed on a company that has violated consumer rights is 450 UIT (S/ 2,070,000 soles). These are the firms that received the largest fines:

  • Cencosud Retail: 447.36 UIT (approximately S/ 2,057,856)
  • Interbank: 150 UIT (approximately S/ 690,000)
  • Americatel Peru: 76.6 UIT (approximately S/ 352,360)
  • América Móvil (Claro): 50 UIT (approximately S/ 230,000)
  • Ripley Bank: 49.8 UIT (approximately S/ 229,080)
  • Banco Falabella: 45 UIT (approximately S/ 207,000)
  • Banco Pichincha: 45 UIT (approximately S/ 207,000)
  • Entel Peru: 45 UIT (approximately S/ 207,000)
  • Effective Financial: 43.9 UIT (approximately S/ 201,940)

How to report companies to Indecopi?

If a citizen considers that a company is coming calling without your consent, you can contact the email [email protected]. Likewise, Indecopi has arranged the hotlines 224 7777 (Lima) and 0800 44040 (other regions).

The Citizen Watch platform is another way to enter information on bad practices on consumer rights. Indecopi received 10,879 reports and queries from this form between March and December 2021. If at any time you granted authorization to companies to call you, you have the right to revoke this permission at any time.
