A few days ago, the Science, Innovation and Technology Commission of the Congress of the republic approved the opinion that approves a new teleworking law, thus repealing the current law 30036 that was implemented in 2013.
Unlike the current teleworking law, the approved text makes some adjustments regarding the costs generated as a result of said work modality. The current norm obliges employers to be in charge of providing the technological equipment, otherwise they must compensate the teleworker when the latter contributes their own work elements.
However, the approved opinion, although it also states that the employer must provide or compensate technological equipment, internet access and consumption of Energy required by teleworkers to carry out their work activities, it is specified that when the worker provides their own equipment, the company may agree with the teleworker so that these costs are not assumed.
The labor lawyer, Ricardo Herrera, explains that this change would be similar to what is available today with remote work, since it is more flexible for the employer to implement it.
In this sense, the expert expressed that, if the initiative is approved, companies could hire teleworkers with a clause that specifies that the employer will not assume the additional costs that are generated.
Another change that is made is that the teleworker is free to decide the place where they will carry out their work, prior notice to their employer. He will also have the right to daily disconnection, which must be at least 12 hours in a 24-hour period. In addition, the working day could be distributed up to a maximum of 6 days a week.
