Doe Run: Indecopi fines Alta Sierra Asesores y Consultores SAC with 101 UIT

Indecopi reported that through the Bankruptcy Proceedings Commission in coordination with the Technical Supervision Secretariat attached to the Bankruptcy Proceedings Commission (FCO), it imposed two fines totaling 101 UIT on Alta Sierra Asesores y Consultores SAC, a former settlement entity for Doe Run Peru (DRP), and its legal representative, for violations of the General Law of the Bankruptcy System.

According to the entity, the company and its legal representative, Luis Alejandro Sierralta Piñeiro, failed to deliver the payment for the La Oroya Metallurgical Complex (CMLO), breaching the ninth clause of Addendum No. 4 of the Liquidation Agreementsigned on September 15, 2020.

Likewise, the Commission sanctioned with 1 UIT the fact that information was not provided in response to a request from one of the labor creditors recognized in the bankruptcy proceeding.

Finally, Indecopi points out that the fines, which together are equivalent to S/464,000, “are the result of the investigations carried out by the FCO in the Doe Run Peru bankruptcy process, for alleged infractions of the bankruptcy regulations.”

It should be remembered that last Monday the creditors’ meeting ratified Consultores A-1 as the new liquidator of Doe Run Perí. On the date, the parties also signed a liquidation agreement in which a liquidation plan for the Cobriza mining unit was approved, which contemplates its direct sale or auction for an amount of no less than US$19,600,000 plus VAT.
