Science Commission approved opinion of new teleworking law

The Science, Innovation and Technology Commission of Congress unanimously approved the opinion to approve a new teleworking law – which would repeal Law 30036, currently in force.

Among the main scopes are that it would govern public servants and private sector workers, who will also have the same rights with respect to those who work in an office.

The president of the commission, Flavio Cruz, pointed out that the voluntariness and reversibility of teleworking is maintained and the use of technologies will be incorporated so that a worker can carry out their work from home.

“It is regulated that the effective working hours achieve the expected results. The right to digital disconnection is incorporated and places limits between work and family life. The compensation of expenses incurred by the teleworker for the labor service and the use of overtime, among other scopes, is also regulated, “explained Cruz.

The opinion also incorporates allowing an employer and a telecommuting server to sign an agreement that guarantees the right to receive equipment, internet access or compensation for the consumption of electricity.

The proposed law has 28 articles, nine final complementary provisions and one repealing complementary provision.
