Can businesses charge an additional percentage for buying with a card?

More and more businesses are committed to digitizing their payments, card payment grew even more than estimated in just two years before the arrival of the pandemic. Electronic commerce before the health crisis represented less than 15% of the total volume and now exceeds 40%, according to Sammy Cabrera, Commercial Manager of VendeMás de Niubiz.

Thus, today more and more people choose to pay with cards to reduce contact, for security, practicality or speed. However, there are still businesses that charge the final customer an additional charge for using this means of payment, is that correct? why do they do it? can you decide not to pay it?

Cabrera explained that they are incorrect and unjustifiable charges. In the case of Niubiz and VendeMás, there is a commission agreed in the establishments, for each sale they make. However, when a business displays prices of its products, this total must already include applicable taxes, commissions and charges.

“Consumers cannot be forced to pay additional amounts or surcharges to the fixed price, except in the case of different or additional services such as transportation or installation, whose remuneration is not included in the price,” he added.

It should be noted that businesses that charge an additional fee for paying by card without advance notice can be penalized with up to 450 UIT; that is, about S/ 2.1 million.
