Sánchez Galán requests the nullity of his complaint and that of Iberdrola Renovables

Ignacio Sánchez Galám has requested the judge of the Manuel García-Castellón National Court the nullity of all proceedings in the Villarejo case since July 2020, including its imputation, and that of Iberdrola Renovables decreed this Friday. The company alleges defenselessness as it has not received any official communication from the Hearing.

Apart from charging the renewable subsidiary, García-Castellón has agreed to dismiss the former Iberdrola executive Juan Antonio del Olmo, Against whom the company had sued for manipulating a private document to harm the interests of the entity. The order does not enter to assess the existence of evidence of the commission of the crime and agrees to file because the facts would be prescribed.

Iberdrola had already requested that the case not be filed, and now it is requesting the annulment not only of this dismissal, but of all the proceedings since July 16, 2020, the date on which a Bilbao court withdrew in favor of the National High Court in a complaint filed by the company against Del Olmo.

According to Iberdrola’s version, Galán’s accusation is based on a document delivered to the judge by Del Olmo that the company considers false. Therefore, if it were investigated and found to be false, the accusation of the Chairman of Iberdrola would be unfounded. Once decided by the judge that it will not be investigated, the company has changed its strategy and has decided to request the aforementioned annulment. This appeal has been presented directly to the judge, who will foreseeably reject it, as a previous step to appeal to the Room.

Iberdrola sources also clarify that “regarding the prescription of the crime of documentary falsity Mr. Del Olmo who prevents Iberdrola from appearing as an injured party in the case, the company wishes to point out that the judge is filing the complaint for exceeding the statute of limitations as it is an alleged crime that was committed in 2004. Iberdrola wishes to emphasize that it was not she can be excluded from the procedure because her character has never been accepted. ‘

On the other hand, company sources have wanted to make it clear that the accusation refers only to an alleged crime of bribery and not those of documentary falsification or disclosure of secrets.

This Friday’s order points out that what is allegedly illegal would be the hiring of an active police officer – hence the only crime charged is that of bribery-, rather than the object of the contract itself.

Likewise, the company complains that this accusation is related to that of the president of Iberdrola, Ignacio Sánchez Galán. «Iberdrola Renovables Energía is a subsidiary of Iberdrola Spain and both companies have their own board of directors, which includes independent directors, and Ignacio Sánchez Galán has never been the chairman or director of either of these two boards, contrary to what the court order says “.

The Chairman of Iberdrola Spain is Francisco Martínez Córcoles, number two of Galán in Iberdrola and also accused in the case, and that of the Renovables subsidiary is Xabier Viteri Solaun.
