Osinergmin imposes a new fine on Repsol for more than S/ 9 million

Osinergmin reported that it will impose new fines on La Pampilla SAA Refinery (Relapasaa) for failing to comply with the schedule established for the removal of the submarine PLEM, which is a key piece in the investigation of the oil spill that occurred in Ventanilla.

The body will initiate a sanction process, whose fine can reach 100 UIT, because the company did not withdraw the PLEM within the established date range.

In addition to this, Osinergmin ordered, through a new mandate, the extraction of the PLEM until Sunday, March 6. However, yesterday afternoon, Friday, March 4, Relapasaa filed an appeal requesting that this new mandate be reconsidered.

On the other hand, Osinergmin imposed a a fine of 1,975 UIT (S/ 9 million 85,000) to Relapasaa for not satisfactorily substantiating the measures that this company will take to guarantee timely warning in the event of a new hydrocarbon leak.

“This sanction will be successively doubled until the company adequately supports the respective measures and these have the approval of the supervisory body,” warned Osinergmin.

The aforementioned coercive fine comes after Osinergmin issued a mandate on February 4 ordering Relapasaa to support complementary measures to ensure early warning of possible leaks under any conditions and at any time. Although the company presented the information requested up to two times, it did not satisfy what was required by Osinergmin.

This new sanction is added to the fine of 40.82 UIT that Osinergmin will also impose on the company for presenting, in the Preliminary Emergency Report, inaccurate information on the volume of spilled hydrocarbons and the extension of the affected area.

Similarly, Osinergmin would initiate a new sanctioning administrative procedure against Relapasaa for failing to comply with the provisions of the Emergency Response Plan for the spill in La Pampilla. It should be noted that the supervisory body has already notified the report prior to the start of the sanction process whose fine could exceed 4 million soles.
