Executive formalizes bill for the return of Fonavi: What is the proposal about?

Yesterday, the Executive Power officially presented the bill that seeks to guarantee the return of money from the National Housing Fund (Fonavi), prioritizing the vulnerable population. As announced by the head of the Ministry of Economy and Finance (FEM), Oscar Graham, this proposal is the alternative to the autograph of the Congress of the Republic observed by the Government.

According to the proposal sent by the Executive, only the contribution of dependent and independent workers would be returned.

Likewise, it is specified that the return of the contributions to Fonavi may not exceed the totality of resources collected from the workers, updated with the Effective Legal Interest Rate, which amounts to just over S/ 6,684 million.

Individual account will be created

The Government is also proposing the construction of the Individual Account of contributions actually made by the Fonavistas in an updated manner. Thus, public and private employers must submit to the Technical Secretariat for Support to the Ad Hoc Commission, the information with the periods and amounts contributed to Fonavi by their workers; in a complementary manner, the former contributor may submit supplementary documentation that serves to prove their contributions.

However, as long as the construction of the Individual Account is completed that establishes the total amount to be returned, It is arranged that an Immediate Return be made as payment on account. “If there is a difference between both amounts, the one that is more favorable to the Fonavista will be considered as a refund,” the bill points out.

It is specified that the amount to be returned to the fonavista will be the product of multiplying the recognized periods by the new value of each monthly period; The latter being the result of dividing the total resources effectively recovered by the Ad Hoc Commission, between the result of multiplying the number of registered potential beneficiaries and the average number of periods contributed.

According to MEF estimates, each Fonavista would immediately receive from S/ 420 to S/ 700 as payment on account.

Scope

The beneficiaries would be entitled to their progressive return, as long as they have complied with paying their debt to Fonavi. In addition, it is proposed that the refund amount to which they are entitled would serve to fully or partially offset the debt they register with said fund.

The proposal clarifies that those workers who benefited from their resources in an amount equal to or greater than their contribution, accessing the housing, electrification and sanitation programs, are exempt from the return of contributions.

What if the fonavista died?

In case the fonavista beneficiary has died, the return could be collected by the surviving spouse or surviving member of the de facto union; children; parents or siblings.

If they are not related, the refund would be granted to those who prove to be beneficiaries of the deceased phonavista, through Intestate or Testamentary Succession.
