The National Civil Service Authority (Servir) has clarified that currently the leave of absence for onomastic only includes civil servants subject to the labor regime of Legislative Decree No. 276. This is established in literal g) of article 147 of the Administrative Career Regulations.
The National Registry of Identification and Civil Status (Reniec) consulted Servir on this issue, an institution that responded with the preparation of the Technical Report 0060-2022-SERVIR-GPGSCwhich concludes that public civil servants contemplated in the labor regime 276 are granted a day off for birthday, as part of the work incentives program. Thus, each entity can establish, through its internal regulations, a different opportunity to effect said rest.
Likewise, it was specified that, in accordance with literal g) of article 6 of Law No. 29849, the Administrative Services Contract (CAS) grants the server the licenses to which workers of the general labor regimes are entitled.
In this way, the institution pointed out that the possibility of accessing leave for the name of the personnel hired under the RECAS It will depend on the labor regime to which the entity’s personnel belongs, and the same license can be applied to them, if it is regulated for the other servers.
