Empresa Fluyez does not have authorization to operate as a virtual bank, clarifies the SBS

The Superintendence of Banking, Insurance and AFPs (SBS) clarified that the company Fluyez Digital Investments SAC does not have the corresponding authorization to operate as virtual bank.

This clarification comes after the company confirmed that it does have the permits and announced the launch of its Cripto Bank de Perú platform to trade cryptocurrencies. However, the entity specified that the Fluyez company is only registered in the Registry of Companies and Persons that carry out Financial Operations or Currency Exchange of the SBS, as an exchange house.

An exchange house is understood as a company dedicated to the purchase and sale of foreign currency, activity that does not include the commercialization of cryptocurrencies”, the SBS pointed out through a statement.

The entity stated that by using the name “bank” by the company, it is violating article 11, paragraph 4, of the General Law of the Financial System and the Insurance System and Organic Law of the Superintendence of Banking and Insurance ( Law No. 26702).

As it does not have authorization to operate as a bank, this company cannot promote the collection of savings from the public. Nor can you use the logo or the name of the SBS to promote its activities, since these constitute the intellectual property of the supervisor and regulator of the financial system”, it adds.

Given this, he stated that the SBS is carrying out the corresponding additional investigations and reserves the right to initiate legal action against the persons who are responsible for the infractions of the regulations that regulate the financial system.
