Indecopi withdraws three pet foods from Nestlé and Rinti for misleading

Indecopi ordered the withdrawal from the market of animal feed products Félix Complete and Balanced Salmon Pate of 156 gr., of Nestlé Peru SA, as well as the Ricocan Lamb (Moist) of 170 gr. Y Ricocan Chunks in Sauce with Chicken and Vegetables of 330 gr., both from Rinti SA, for misleading consumers with poor labeling.

The decision adopted by the Specialized Chamber for Consumer Protection (SPC) of Indecopi establishes that the three products implied that they were composed only of certain ingredients, “when in fact they contained additional ones.”

The SPC specified that the product “Félix Pate Complete and Balanced Salmon” of 156 gr. of Nestle It not only had salmon, but also pork offal, chicken and/or turkey offal, and fish meat.

In the case of Rinti, its product “Ricocan Lamb (Wet)” of 170 gr. it also contained beef and poultry derivatives, meat meal, as well as animal and vegetable fat; Similarly, the product “Ricocan Chunks in sauce with Chicken and Vegetables” of 330 gr., also contained pork and/or pork derivatives and porcine plasma.

In that sense, and in order to safeguard consumers’ right to information, Indecopi ordered Nestlé and Rinti to withdraw the aforementioned products from the market until they comply with labeling them correctly.

Finally, through Resolutions 0222-2022/SPC-INDECOPI and 0223-2022/SPC-INDECOPI, the Chamber sanctioned both companies in the second and last instance. Nestlé received a fine of 50 UIT equivalent to S/ 230,000, while Rinti with 20 UIT, equivalent to S/ 92,000.

It is necessary to clarify that the decision of the SPC does not affect the freedom that companies have to decide the name of their products as they deem most convenient, within the framework of the law.

“However, the names they place must convey to consumers a correct idea of ​​what they really contain, in those cases in which, of their own free will, companies choose to highlight any of the ingredients,” the regulatory body remarked.

Indecopi: in defense of the consumer

The Specialized Chamber in Consumer Protection of the Indecopi Court It is a body that belongs to the resolution area of ​​the institution and is made up of independent professionals who resolve cases according to their specialized knowledge and in accordance with the current legal framework.

The decision-making bodies of Indecopi are autonomous in the exercise of their functions and their decisions are not subject to control by the Presidency of the Board of Directors, the General Management or any of the Managements that make up the administrative structure of Indecopi, in accordance with what is established in article 21 of the Indecopi Organization and Functions Law.
