The Contentious-Administrative Chamber of the High Court of Justice of the Basque Country (TSJPV) has declared the partial annulment of Biscay personal income tax regulations in relation to the income tax filing procedure through the electronic headquarters of the Provincial Council.
In a statement reporting the court’s ruling, the Bizkaia Provincial Council explains that the sentence partially estimates the rappeal filed by a private person against obligation to submit the declaration in the electronic office Y about the notification procedure.
The conflict starts with 2021 income statementwhen the Provincial Council of Bizkaia launched a new model for the campaign that began on April 6 and that caused countless complaintsincluding those of pensioner movement. On April 27, the Provincial Council admitted calculation errors in the new income and on the 29th, the Deputy General of Bizkaia, Unai Rementeria, requested sorry for the “headaches” of the new model.

The Provincial Council ensures that “does not share the interpretation made by the Court” that it is mandatory to present the declaration at the electronic headquarters of the Diputación, and reiterates that taxpayers “may choose to present their income declaration online, by telephone and in person at the regional offices”.
He insists that “the electronic office is not the only filing channel” and adds that, although it is the channel “most demanded by taxpayers”, in the last Income campaign there were 163,034 people who filed their tax return by phone, in offices or automatically. “They represented 25.6% of the total of 636,264 declarations presented,” the Provincial Council specifies.
He assures that he does not share the interpretation that the court makes about the notifications in the electronic headquarters, since according to the Foral Treasury, “it also sends paper notifications to people who do not access them through the electronic headquarters”.
For this reason, the Provincial Council of Bizkaia announces that it will present a appeal to the Supreme Court.
Finally, the provincial institution indicates that “in the next rental campaign, assistance services and telephone and face-to-face presentation will be reinforced.”
