The Executive power published the guidelines so that the right to collective bargaining of workers can be exercised public sector workers from all over the country.
In this way, all state workers will be able to negotiate salary increases, bonuses for good performance and Labor conditions, among other requests, both economic and non-economic, which may be made at a centralized or decentralized level.
One of the aspects required by the standard is that the Ministry of Economy and Finance (MEF) must issue a Final Report on the Situational Status of the Financial Administration of the Public Sector, which will establish, among other aspects, the fiscal space that must be considered by the parties that carry out collective bargaining. This with the aim of guaranteeing budget viability for the execution of the agreements.
Edgardo Balbin, former general director of the Ministry of Labor and Employment Promotion (MTPE), points out that although the report is being included in the guidelines, it is necessary so that negotiations can be carried out; however, he pointed out that this report would not be binding, but would only serve as an orientation so that availability is known.
”It regulates the issuance of two reports, at the macro level and one specific to the conditions of each entity. It is important to remember that, Although the rule does not expressly indicate it, it will have a guiding nature and not a binding one for the parties”, Balbin noted.
Regarding these reports that he would prepare, the Front of State Workers of Peru (FTEP) was in rejection, since they consider that “it would be seriously affecting the principle of autonomy and respect for the freedom of workers and employers.”
On the other hand, the norm indicates that the agreements must be reached until June 30, so that the MEF can consider it within the public budget, since in this way the signed agreement can be fulfilled from the 2023.
